An
individual who is convicted of a criminal offense,
may seek an appeal if their is cause which warrants
an appeals hearing, giving the convicted party the
ability to have a conviction overturned.
Those who choose to contest a conviction must officially file an
appeal with the appropriate Court Of Appeals.
You must file the appeal in the district which has jurisdiction
in the county in which your conviction occurred.
Contrary to popular belief, an appeal in not a new trial, but
rather a forum in which you and your attorney (lawyer) must
persuade the court of appeals that the existence of legal errors
occurred during the course of your trial, and that because of
those errors,
the conviction must be reversed.
The longer you wait to obtain the legal
services of an experienced court appeals attorney
or lawyer, your ability to achieve a successful or
desired result in your legal situation may be dramatically
reduced.

The first act in the appellate process is to file
the "Notice Of
Appeal". This document officially informs
the trial court and opposing counsel of your intent
to appeal your conviction. The next step is to
request that the trial court
"transmit
the record" of the trial level proceedings,
and that you be provided a copy of the
transcript.
Your criminal appeals attorney (lawyer) may do all
of this on your behalf. Your appellate attorney will
initially argue on your behalf in what is known in
what is known as an appellate brief.
In the appeals process, you do not argue the facts of the case,
whether you were guilty or not guilty), and may not provide
additional evidence. In the appeals process, you are only
permitted to present an argument based on the actual contents of
the trial transcript and other records from the trial court.
